The Paid Family Leave Benefits Law allows individuals to receive sixty-seven percent of their average weekly wage for no more than twelve weeks in which an employee cannot perform their work duties in order to care for a family member, to bond with a child during the first twelve months of the child's birth or the child's placement for adoption or foster care, or because of any qualifying exigency arising when a spouse or partner is on active duty without fear of being terminated, retaliation, or losing any health benefits afforded by employer.

43:21-25 states that any individual elegible for benefits during a period of family temporary disability leave shall recieve 6 times their weekly benefit amount or one third of their total wages, whichever is lesser, under a private or state plan of disability benefits to care for a seriously ill or injured family member, or bond with a newborn, newly adopted or newly placed foster child for a maximum of twelve consecutive weeks in a calendar year. This bill was expanded in 2019 by A3975, which increased the paid leave to 12 weeks from July 1, 2020.

The legislation provides up to six weeks of wage replacement benefits to workers who take time off of work to care for a seriously ill child, spouse, parent, or domestic partner, or to bond with a new child. The law took effect July 1, 2004. In 2013, SB 770 expanded California’s PFL benefits to workers who take time off work to care for a seriously ill parent-in-law, grandparent, grandchild, or sibling. In 2019, SB 83 extended the PFL from six to eight weeks.
