This law prohibits employers from asking about a prospective employee’s compensation history until after that employer has extended a job offer including compensation terms. The law also bars employers from making such inquiries directly to the candidate’s current or former employer and allows the Maine Human Rights Commission to use compensation history inquiries as evidence of discrimination. The law does, however, allow employers to confirm a candidate’s compensation history if the candidate voluntarily discloses it. Additionally, the law strengthens existing wage transparency laws by clarifying that employers may not stop current employees from discussing their own or another employee’s wages.
