STATUS: Enacted

Provides additional requirements and specifications regarding required registration with the state of janitorial contractors and required sexual harassment prevention training for employees and supervisors working in the janitorial industry.

This law builds upon AB 1978 (2016) which required janitorial contractors to register with the state and provide sexual harassment prevention training to employees. AB 547 contains additional state registration and certification requirements for janitorial contractors; requires the Department of Industrial Relations to convene a training advisory committee to assist in compiling a list of qualified organizations and peer trainers for required use in the sexual harassment prevention training, and 3) requires employers to use a qualified organization from the list of qualified organizations to provide the required training, and requires that qualified organizations provide peer trainers for employers to use in the training, as specified. Finally, new law requires the employer to pay the qualified organization a specified amount per participant, unless an alternative payment has been agreed to pursuant to a collective bargaining agreement. The law requires the qualified organization to ensure that the peer trainer is paid at least twice the state minimum wage per hour.
