Under this legislation, no employer shall pay an employee a wage at a rate less than the rate at which an employee of the opposite sex in the same establishment is paid for equal work on a job, the performance of which requires equal skill, effort and responsibility, and which is performed under similar working conditions. This legislation rubber stamps employers’ decision to pay women less for equal work, by allowing them to use factors other than sex specified in the law -including salary history, continuity of employment, competition with other employees for the employee’s services, and the extent to which the employee attempted to negotiate for higher wages-.
