This bill prohibits wage theft in garment manufacturing by instituting hourly wage requirements and holds contractors, in addition to manufacturers, liable for violations.

This bill establishes the The Garment Worker Protection Act, which prohibits wage theft in manufacturing. This act prohibits employees to be paid per item and requires hourly wages instead. A payment of $200 per employee of compensatory damage is instituted for each pay period where an employee was paid per piece. Loopholes in existing law are remedied by ensuring contractors are also held liable for violations, and garment manufacturers, contractors, and brand guarantors who contract someone to manufacture garments together share liability for the full sum of unpaid wages and other compensations, including civil penalties and attorney’s fees. Record keeping requirements for employers in garment manufacturing and the definition of garment manufacturing are also expanded.
