Expands an existing prohibition on non-disclosure agreements in settlements to cover agreements involving all forms of harassment or discrimination.

Expands an existing prohibition on non-disclosure and non-disparagement agreements in settlements to cover agreements involving all forms of harassment or discrimination, including those not based on sex. Proclaims it is an unlawful employment practice for an employer or former employer to include in any agreement related to an employee’s separation any provision that prohibits the disclosure of information about unlawful acts in the workplace, and makes any such agreement unenforceable. Also requires a non-disparagement or other restriction on an employee’s ability to disclose information to include specified language about an employee’s right to disclose information about unlawful acts in the workplace.
