CA AB 1949

2022 | Bereavement Leave, Leave

STATUS: Enacted

Allows workers to take up to 5 days of unpaid, job-protected bereavement leave upon the death of a family member, as defined. It also prohibits employers from firing or otherwise discriminating against employees for taking the leave.

This bill makes it an unlawful employment practice for an employer to refuse to grant a request by an eligible employee to take up to 5 days of bereavement leave upon the death of a family member, whether this be a child, parent, sibling, grandparent, grandchild, domestic partner, or parent-in-law. The bill requires that leave be completed within 3 months of the date of death. It also requires that the leave is being taken pursuant to any existing bereavement leave policy of the employer. In the absence of an existing policy, the bereavement leave may be unpaid.
