STATUS: Enacted

43:21-25 states that any individual elegible for benefits during a period of family temporary disability leave shall recieve 6 times their weekly benefit amount or one third of their total wages, whichever is lesser, under a private or state plan of disability benefits to care for a seriously ill or injured family member, or bond with a newborn, newly adopted or newly placed foster child for a maximum of twelve consecutive weeks in a calendar year. This bill was expanded in 2019 by A3975, which increased the paid leave to 12 weeks from July 1, 2020.

The legislation provides up to six weeks of wage replacement benefits to workers who take time off of work to care for a seriously ill child, spouse, parent, or domestic partner, or to bond with a new child. The law took effect July 1, 2004. In 2013, SB 770 expanded California’s PFL benefits to workers who take time off work to care for a seriously ill parent-in-law, grandparent, grandchild, or sibling. In 2019, SB 83 extended the PFL from six to eight weeks.

Section 28-41-35 states that employees are elegible for temporary caregiver benefits for any week (up to four weeks in a benefit year) they are unable to perform customary work because they are bonding with a newborn or newly adopted child, or because they are caring for a child or family member without fear of potential termination, employer retaliation, or loss of health care benefits. This bill is expanded by H.B. 6090, § 1, 2021-2022 Leg. Sess. (R.I. 2021).

The Paid Family and Medical Leave Act will provide up to twelve weeks of family and medical leave compensation to covered employees during a twelve-month period as well as an additional two weeks of compensation to a covered employee for a serious health condition resulting in incapacitation that ocurrs during pregnancy. As such, employees can take time off to bond with a child within one year of birth or placement from foster care/adoption or to care for aa family member with a serious health condition.
