Section 28-41-35 states that employees are elegible for temporary caregiver benefits for any week (up to four weeks in a benefit year) they are unable to perform customary work because they are bonding with a newborn or newly adopted child, or because they are caring for a child or family member without fear of potential termination, employer retaliation, or loss of health care benefits. This bill is expanded by H.B. 6090, § 1, 2021-2022 Leg. Sess. (R.I. 2021).

Section 28-41-35 states that employees are elegible for temporary caregiver benefits for any week they are unable to perform customary work because they are bonding with a newborn or newly adopted child, or because they are caring for a child or family member. In order for employees to access this benefit they must provide written notice to employer 30 days in advance. It also states that employees who take leave must have access to the same position or equal position upon return. Temporary caregiver benefits are limited to four weeks per year. During the leave an employee is also guanateed continued access to exisitng health benefits as if they are still employed for the entire duration of the leave. An individual can also not access the temporary caregiver benefits and temporary diability benefits that exceed 30 times their benefit rate in a year.
