43:21-25 states that any individual elegible for benefits during a period of family temporary disability leave shall recieve 6 times their weekly benefit amount or one third of their total wages, whichever is lesser, under a private or state plan of disability benefits to care for a seriously ill or injured family member, or bond with a newborn, newly adopted or newly placed foster child for a maximum of twelve consecutive weeks in a calendar year. This bill was expanded in 2019 by A3975, which increased the paid leave to 12 weeks from July 1, 2020.

This legislation states that any individual elegible for benefits during a period of family temporary disability leave shall receive 6 times their weekly benefit amount or one third of their total wages, whichever is lesser, under a private or state plan of disability benefits to care for a seriously ill or injured family member, or bond with a newborn, newly adopted or newly placed foster child for a maximum of twelve consecutive weeks in a calendar year. Any individual is elegible for benefits if they are employed or have been out of employment for less than two weeks unless they are receiving benefits under a different state law plan. The individual must first use paid time off provided by employer before being elegible for the disability benefits. Employers must participate in the state’s public insurance programs and deduct payroll taxes for employees working in NJ, or employers may choose to provide employees coverage through a private insurance plan that meets NJ requirements.
