2018 | Fair Pay, Leave, Paid Sick Leave

Provides for the accrual of one hour of sick and safe leave for every 30 hours worked. Leave is paid if employer employs more than 15 employees or unpaid if employer employs fewer individuals.

Maryland law requires non-exempt employers of more than 15 employees to provide paid sick and safe leave to non-exempt employees, accrued at a rate of one hour for every 30 hours worked. Non-exempt employers who do not meet the 15 employee threshold are still required to provide sick and safe leave, although this leave is unpaid. Employees may accrue up to 40 hours and use up to 64 hours of sick and safe leave per year. Total number of hours accrued may not exceed 64 hours. Sick and safe leave may be used to obtain or provide care for the employee’s own or their family members “mental or physical illness, injury, or condition,” for maternity and paternity leave, or to seek care or services if they or their family members are facing domestic violence, sexual assault, or stalking. “Family member” is defined broadly for the purposes of this section and includes biological and nonbiological children, parents, grandparents, grandchildren, and siblings.
