Illinois HB 816

2021 | Fair Pay, Leave, Paid Sick Leave

STATUS: Enacted

Removes language that specifies that the sick leave provisions apply to birth, adoption, or placement for adoption. Instead, provides that (i) sick leave shall also be interpreted to mean birth, adoption, or placement for adoption;

This law amends the school code so that sick leave can be interpreted to mean birth, adoption, placement for adoption, or acceptance of a child in need of foster care. Certain teachers and employees can use up to 30 days of paid sick leave because of a the birth of a child that is not dependent on recovering from childbirth. Additionally, paid sick leave because of the birth of a child may be used without medical certification for up to 30 school days anytime within the 12-month period after the birth of the child. Paid sick leave for the adoption or placement for adoption may require the employee to provide evidence of a formal adoption process being underway, and this paid sick leave is limited to 30 days unless a longer leave has been negotiated.
