Limits Non-Disclosure Agreements

Amends existing NDA law to prohibit employers from requiring as a condition of employment that an employee or prospective employee sign or renew an NDA, confidentiality agreement, or non-disparagement agreement that has the purpose or effect of concealing the details relating to a claim of sexual assault or sexual harassment. Previously, Virginia’s law only applied to sexual assault claims and did not reach harassment claims that did not include sexual assault allegations. The amended law also explicitly reaches non-disparagement agreements for the first time. While the amendments expanded the scope of the state law slightly, they are duplicative of the protections provided by the federal Speak Out Act.
