Provides for the accrual of one hour of sick leave for every 30 hours worked or one and one-third hours for every 40 hours worked. Leave is paid if employer employs more than 10 employees.

Oregon law requires non-exempt employers of 10 or more employees to provide up to 40 hours of paid sick leave per year accrued at a rate of one hour of leave for every 30 hours worked or one and one-third hours for every 40 hours worked. Employers of fewer than 10 employees must still provide up to 40 hours of unpaid leave per year accrued at the above rate. The full 40 hours of leave may be carried over to the following year by the employee, however, the employer may limit the total amount of leave accrued to date to 80 hours. Sick leave may be used by the employee for their or their family member’s mental or physical illness, injury, or health condition, for family leave if covered under such laws, or to address their own or their dependent child’s needs based on domestic violence, sexual assault, harassment, or stalking. Sick leave can also be taken during public health emergencies if the employee’s place of work or their child’s school/place of care is closed, or if they or their family members are required to remove themselves from the workplace to avoid jeopardizing the health of themselves or others. Family member is defined as “spouse of an employee, the biological, adoptive or foster parent or child of the employee, the grandparent or grandchild of the employee, a parent-in-law of the employee or a person with whom the employee was or is in a relationship of in loco parentis.”
