This law requires that each agency of a governmental entity develop and institute a policy to prevent sexual harassment, applicable to all public servants, employees, and elected officials, adding that the policy, at a minimum, must include a description of the investigation process and a description of potential disciplinary action. It also reaffirms the right of a complainant to pursue a claim. The law also outlines who is responsible for payment in cases where sexual harassment has been determined to have occured by a public official requiring the sexual harasser to pay some or all of the costs related to a settlement or judgment. It gives the state the right to seek reimbursement and indemnity from the sexual harasser.
